Restraining Orders

How We Help With Restraining Orders

Restraining order cases have two sides, and we represent people on both. If someone has threatened, harassed or abused you, a restraining order can provide legal protection. If you have been served with a request for an order, what happens at the hearing can affect where you live, your access to your children, your right to own firearms and even your job.

We handle the three types of civil restraining orders that come up most often. A domestic violence restraining order protects against abuse by a spouse, partner, family member or co-parent. A civil harassment restraining order covers people outside that close relationship — a neighbor, coworker or acquaintance. An elder or dependent adult abuse restraining order protects people 65 and older, or dependent adults, from physical, financial or other abuse.

These cases move quickly. A judge often decides on a temporary order within a day or so of filing, and a full hearing is usually set within a few weeks. We help you prepare evidence and testimony so the court hears your side clearly and calmly.

FAQ

Restraining Orders Questions

What is a temporary restraining order?

A temporary restraining order (TRO) is a short-term order a judge can issue soon after a request is filed, often without the other side present. It lasts until the court hearing, where the judge decides whether to grant a longer order.

How long does an order last?

A restraining order issued after a hearing can last up to five years for domestic violence, civil harassment and elder abuse orders, and it can often be renewed. The judge decides the length based on the facts.

What if I'm served?

Read the papers carefully and follow every term of the temporary order immediately, even if you disagree with it. Note the hearing date, file a response if you plan to contest it, and gather evidence. Contact a lawyer as soon as possible.

Can I request one without a lawyer?

Yes. Courts have self-help resources, and many people file on their own. A lawyer can help you choose the right type of order, present evidence effectively and handle a contested hearing, especially if the other side has an attorney.

What happens if an order is violated?

Violating a restraining order is a crime in California. The protected person can call the police, and the person who violated it may be arrested and prosecuted. Only the court can change the order — not an agreement between the parties.

Does it affect firearms or custody?

Yes. A person restrained by most California restraining orders cannot own or possess firearms while the order is in effect and must surrender any they have. Domestic violence orders can also include temporary custody and visitation terms.
