How We Help With Domestic Violence Defense
A domestic violence accusation can change your life overnight. A single call can lead to an arrest, an emergency protective order that keeps you out of your own home, restrictions on owning firearms, and questions in family court about custody of your children — often before you have had any chance to tell your side.
These cases involve people who share a home, a child or a relationship, so they are rarely simple. Feelings run high, stories can change, and the evidence is often incomplete. We approach every case with discretion and respect for everyone involved, while making sure your rights are protected at each step.
Acting early matters. Protective orders take effect immediately, and the first court date can come quickly. Attorney George L. Fernandez reviews the arrest report and any orders, explains what you can and cannot do while the case is pending, and builds a defense focused on the facts.

FAQ
Domestic Violence Defense Questions
Can the alleged victim drop the charges?
No. In California, the prosecutor — not the alleged victim — decides whether to file or dismiss criminal charges. The person's wishes can still be relevant, but the case does not automatically end if they no longer want to proceed.
What is a criminal protective order?
It is an order issued by the criminal court while the case is pending, and sometimes after it ends. It may require you to stay away from the protected person, move out of a shared home, or have no contact at all. Violating it is a separate crime, even if the other person agrees to contact.
Can I go home after an arrest?
It depends on the terms of any emergency or criminal protective order. Many orders require the accused person to stay away from the home. Read the order carefully and follow it until a court changes it — we can ask the court to modify the terms.
Will this affect custody?
It can. Under California Family Code section 3044, a finding of domestic violence within the past five years creates a presumption against awarding custody to that parent. That makes the criminal defense and any family-court case closely connected.
Can I own a firearm?
Generally not while a protective order is in effect, and a domestic violence conviction can carry long-term state and federal firearm restrictions. If you own firearms, ask your lawyer immediately what you are required to do with them.
Can the case be dismissed?
Sometimes. Cases may be dismissed or reduced when evidence is weak, statements are inconsistent, or there is a strong self-defense claim. Some cases resolve through negotiated outcomes. No result can be promised, but a careful defense gives you the best chance.
