In the moments after a crash, it is hard to think clearly. Keeping a simple checklist in mind can protect both your health and any claim you may have later.
At the scene
- Check for injuries and call 911 if anyone is hurt.
- Move to a safe place if you can do so safely.
- Call the police, especially if there are injuries or significant damage.
- Exchange names, contact details, license and insurance information with the other driver.
- Take photos of all vehicles, the scene, traffic signs, skid marks and any visible injuries.
- Get the names and phone numbers of witnesses.
In the following days
Get medical care
Some injuries, like whiplash or concussions, may not show symptoms right away. See a doctor promptly and follow the treatment plan. Medical records are important evidence.
Report the accident
Notify your own insurance company. In California, you generally must also report the accident to the DMV within 10 days if anyone was injured or killed, or if property damage exceeded $1,000.
Be careful with the other insurer
The other driver's insurance adjuster may call quickly and ask for a recorded statement. You are generally not required to give one. Anything you say can be used to minimize your claim, so consider talking to a lawyer first.
Stay off social media
Insurance companies sometimes review social media to look for photos or comments that seem to contradict an injury claim. It is safest to avoid posting about the accident, your injuries or your activities until the claim is resolved.
Keep records
- Medical bills and records
- Repair estimates
- Missed work and lost pay
- A journal of pain and daily limitations
Watch the deadlines
California generally allows about two years to file a personal injury lawsuit, and claims against a government agency usually must be filed within six months. Learn more about our Long Beach personal injury services.
